Lex Luthor is the most intelligent human being on Earth and one of the most intelligent beings in DC Comics. He has seemingly mastered every science known to the universe. He is able to execute the most effective and efficient solution possible in any given situation.
Regardless of continuity, if two of the most intelligent men in comics history consider Batman to be at least be their intellectual equal, if not their better, it's clear that he's earned his station as DC Comics' smartest man. Batman and Lex Luthor share a lot of similarities.
Superman is smarter in a processing manner, Batman is smarter in a decisive manner. Smart can mean alot of things. And yes, Superman is smarter than Batman in certain ways, but Batman overall is better at using his smarts more efficiently.
