While the original character who appeared in published works before 1923 is in public domain, the version of the character used by Disney, or any other post-1923 works are, most obviously, NOT (this includes the name "Jiminy Cricket" which was created by Disney).

Jiminy Cricket is the Disney version of the "Talking Cricket" (Italian: Il Grillo Parlante), a fictional character created by Italian writer Carlo Collodi for his 1883 children's book The Adventures of Pinocchio, which Walt Disney adapted into the animated film Pinocchio in 1940.
Speaking of his name, Jiminy wasn't invented by Disney. At the time, “Jiminy Cricket” was a polite euphemism for Jesus Christ. The expression was actually used (as an exclamation) in Snow White and the Seven Dwarfs, The Wizard of Oz, and the 1938 Mickey Mouse short, The Brave Little Tailor.

Why did they rename Jiminy Cricket?
It's only associated with the Disney adaptations and other media produced by the studio. In Collodi's 1883 children's novel The Adventures of Pinocchio, the character is simply called the Talking Cricket. That's no fun, though, so del Toro and co-writer Patrick McHale gave their version the name Sebastian J. Cricket.

Originally a pompous, uptight little cricket, Jiminy's personality was changed when the voice talent, Cliff Edwards, was added to the film. Edwards was a well-known singer and actor who was famous for the song, “Singin' in the Rain” and his use of the ukulele.
Collodi often used the Italian Tuscan dialect in his book. The name Pinocchio is possibly derived from the rare Tuscan form pinocchio (“pine nut”) or constructed from pino (“pine tree, pine wood”) and occhio ("eye").
