Tobey Maguire and Andrew Garfield returned to their Spider-Man roles in a multiversal adventure in the MCU film, Spider-Man: No Way Home. The duo alongside Tom Holland's Spider-Man fought some of the iconic villains from the earlier Sony movies.
It was not until Spider-Man: No Way Home that Tobey Maguire's Peter Parker officially joined the MCU. The multiverse movie brought Tobey back as Spider-Man 14 years after he last played the role. Tobey Maguire was not the only Spider-Man trilogy cast member to appear in the multiverse film.
For starters, it's now apparent that Spider-Man: No Way Home won't be the last time we see Andrew Garfield as Peter Parker. However, he isn't going to be taking Tom Holland's place as the MCU's main Spidey (instead, we're guessing he'll be part of one or both of the next Avengers movies).

After selling the Spider-Man motion picture rights to Sony, Marvel eventually founded its own studio, developing the Marvel Cinematic Universe (MCU) based on the characters they still held the rights to. What movie kicked off the MCU?
The first MCU film, Iron Man (2008), began Phase One which culminated in the 2012 crossover film The Avengers. Phase Two began with Iron Man 3 (2013) and concluded with Ant-Man (2015). Phase Three began with Captain America: Civil War (2016) and concluded with Spider-Man: Far From Home (2019).
The independent studio Cannon Films bought the rights to Spider-Man, tried and failed to make a Spider-Man movie, then went bankrupt; in 1996, so did Marvel. The rights to Spidey were lost in litigation until 1999, when Marvel recovered them and sold them to Sony.

In the comics, most of the most recognizable Avengers already know, since Spider-Man publicly revealed his identity during the Civil War storyline (which had disastrous results). So any Avenger who didn't know already, learned when Peter revealed his identity to the world.

The actor was 'let go' from the part after he failed to show up at an event where Sony CEO Kaz Hirai was meant to unveil The Amazing Spider-Man 3 for a 2017 release, it was disclosed in an email after the infamous Sony breach of 2014. The absence of Holland's Spider-Man is likely a conscious decision by the producers, rather than a contractual or legal issue. The decision to only reference Holland's Spider-Man allows the movie to focus on introducing and exploring other versions of the character, without overshadowing them.
Why is Spider-Man not a part of the Marvel Avengers? Spider-Man wouldn't have been too good at taking orders. As a superhero, he prefers working alone, the Avengers would find his conceit and quips rather irritating. At the most, Spider-Man has collaborated with the team on a few occasions but nothing more.
